Experimental Service Notice
BinaryLoom Chat is an experimental AI service. By using this service, you acknowledge that it may contain bugs, produce errors, or experience downtime. The service is provided "AS IS" without warranties. While we are committed to maintaining data integrity and service continuity, external factors (security incidents, abuse, unsustainable costs, or other circumstances beyond our control) may require service modification or discontinuation at any time without notice. Please read these terms carefully.
1. Acceptance of Terms
By accessing or using BinaryLoom Chat at chat.binaryloom.io ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these terms, you may not use the Service. We reserve the right to modify these terms at any time. Continued use after changes constitutes acceptance.
2. Service Description
BinaryLoom Chat is an AI-powered chat application that provides:
- - Access to multiple AI models (GPT-5.1, Claude, Mistral, and others)
- - File upload and processing capabilities
- - Speech-to-text and text-to-speech features
- - Custom AI agent creation
- - Document analysis and OCR
The Service uses third-party AI providers (OpenAI, Anthropic, Mistral) to generate responses. We do not control these providers' outputs.
3. Usage Allowances
The Service currently provides users with a monthly token allowance:
- Current Allowance: 100 million tokens per user per month
- Refresh: Allowances reset monthly
Subject to Change: Token allowances may be adjusted up or down at any time based on demand, costs, abuse patterns, or other operational factors. We will make reasonable efforts to notify users of significant changes, but adjustments may occur without prior notice.
4. Eligibility
To use the Service, you must:
- - Be at least 16 years of age
- - Have the legal capacity to enter into binding agreements
- - Not be prohibited from using the Service under applicable laws
- - Create only one account per person
5. Account Responsibilities
You are responsible for:
- - Maintaining the confidentiality of your account credentials
- - All activities that occur under your account
- - Immediately notifying us of any unauthorized access
- - Ensuring your contact information is accurate and current
We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our discretion.
6. AI-Generated Content Disclaimers
IMPORTANT: READ CAREFULLY
AI Interaction: You are interacting with artificial intelligence systems powered by large language models (LLMs). Responses are generated by AI and may not always be accurate, complete, or suitable for your specific situation.
No Warranties: AI-generated content is provided "AS IS" without any warranties, express or implied, including but not limited to warranties of accuracy, completeness, merchantability, or fitness for a particular purpose.
Not Professional Advice: AI-generated responses do NOT constitute professional advice (legal, medical, financial, or otherwise). Always consult qualified professionals before acting on any AI-generated information.
Potential Errors: AI systems may produce errors, hallucinations, biased outputs, or inappropriate content. We cannot guarantee the accuracy of any AI-generated content.
Your Responsibility: You are solely responsible for reviewing, verifying, and validating all AI-generated content before use. Any reliance on AI-generated information is strictly at your own risk.
7. Acceptable Use Policy
You agree NOT to use the Service to:
- - Generate illegal, harmful, threatening, abusive, or harassing content
- - Create content that promotes discrimination, violence, or hatred
- - Generate spam, phishing content, or malware
- - Attempt to bypass safety measures or content filters
- - Reverse engineer, decompile, or attempt to extract AI model weights
- - Use automated systems to access the Service without permission
- - Impersonate others or misrepresent your identity
- - Violate any applicable laws or regulations
- - Infringe on intellectual property rights of others
Violation of this policy may result in immediate account termination without notice.
8. Intellectual Property
8.1 Our Property
The Service, including its design, features, and branding, is owned by Jason Holt Digital. You may not copy, modify, or distribute any part of the Service without permission.
8.2 Your Content
You retain ownership of content you create and submit. By using the Service, you grant us a limited license to process your content solely for providing the Service.
8.3 AI-Generated Content
AI-generated content ownership may be subject to the terms of underlying AI providers. We make no guarantees regarding intellectual property rights in AI-generated outputs. You are responsible for ensuring any AI-generated content you use does not infringe on third-party rights.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
1. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
2. WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
3. THIS INCLUDES BUT IS NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
4. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100). AS THIS SERVICE IS PROVIDED FREE OF CHARGE, YOU ACKNOWLEDGE THAT THIS LIMITATION IS FAIR AND REASONABLE.
5. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. Disclaimer of Warranties
WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING:
- - Any warranty that the Service will be uninterrupted, secure, or error-free
- - Any warranty regarding the accuracy or reliability of AI-generated content
- - Any warranty that the Service will meet your specific requirements
- - Any warranty regarding the availability of the Service at any given time
- - Any implied warranty of merchantability or fitness for a particular purpose
11. Indemnification
You agree to indemnify, defend, and hold harmless Jason Holt Digital, its affiliates, and personnel from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- - Your use or misuse of the Service
- - Your violation of these Terms
- - Your violation of any third-party rights
- - Content you submit to the Service
- - Any reliance on AI-generated content
12. Third-Party Services
The Service uses Microsoft Azure AI Foundry to access AI models from various providers including OpenAI (GPT), Anthropic (Claude), Mistral AI, and Cohere. All AI processing is routed through Azure's infrastructure.
Important: Because we use Azure AI Foundry (not consumer AI services like ChatGPT), your prompts and conversations are NOT used to train AI models. See our Privacy Policy for detailed information on Azure's data handling policies.
We are not responsible for third-party provider availability, performance, or content policies. Model outputs are generated by AI systems and may vary in quality and accuracy.
13. Data and Backups
Your Responsibility: You are responsible for maintaining backups of any important data you submit to the Service.
While we implement reasonable data protection measures, we do not guarantee that your data will never be lost or corrupted. We recommend regularly exporting any important conversations or content.
14. Service Modifications and Termination
We reserve the right to:
- - Modify, suspend, or discontinue the Service at any time without notice
- - Change features, pricing, or availability
- - Terminate your account for any reason
- - Remove content that violates these terms
Upon termination, your right to use the Service ceases immediately. Sections regarding liability, indemnification, and dispute resolution survive termination.
15. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved through:
- Informal Resolution: Contact us first at privacy@jasonholtdigital.com to attempt resolution
- Mediation: If informal resolution fails, parties agree to attempt mediation
- Courts: If mediation fails, disputes shall be subject to the exclusive jurisdiction of the state or federal courts located in Delaware, USA
For EU consumers, nothing in these terms affects your statutory rights under consumer protection laws in your country of residence.
16. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
No Waiver: Our failure to enforce any right does not waive that right.
Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control (natural disasters, war, pandemics, infrastructure failures, etc.).
